Nebachiv respects third-party intellectual property. Below is our position on copyright and the takedown procedure.

1. Our position

The Platform uses third-party videos for educational analysis (commentary / criticism) of road incidents. Each video is accompanied by an original breakdown that adds educational value.

We rely on free-use-for-criticism-and-education principles (DMCA §107 fair use; EU Copyright Directive art. 17 — quotation, criticism, review; Ukrainian Copyright Law art. 21).

2. Takedown request

If you are a rights holder and believe your content is used in violation — email nebachiv@gmail.com. The request must include:

  • A description of the protected work (or a link to the original).
  • The Nebachiv URL(s) with the disputed content.
  • Your contact details (name, email).
  • A good-faith statement that the use is unauthorized.
  • A statement that the information is accurate and you are the rights holder or authorized agent.
  • A signature (physical or electronic).

3. Processing times

  • Acknowledgement — 24 hours.
  • Review — up to 48 hours.
  • Removal (if justified) — up to 72 hours.

4. Counter-notification

If content was removed by mistake — send a counter-notification to nebachiv@gmail.com with identification of the content, a statement that removal was erroneous, consent to the relevant court jurisdiction, and a signature. We may restore content within 10–14 business days absent a lawsuit.

5. Repeat infringers and attribution

We maintain a repeat-infringer policy: warning → restriction → account block.

For third-party videos we aim to credit the source and mark "used for educational analysis".
