Terms of Service

This document is a public offer to enter into an agreement for access to the digital educational content of the Nebachiv platform. Paying for any paid product on nebachiv.com constitutes full acceptance of these terms. The Ukrainian version (Публічна оферта) is the legally binding one.
1. Parties and definitions
Provider: sole proprietor Chyngys Barynov (ФОП Баринов Чингіз Кубанович), tax ID 2949915218, address: 03118, Kyiv, Krasnozvezdnyi Ave, 130, 256 ("Nebachiv", "we").
User — an individual who accepted these terms by making a payment ("you").
Platform — the nebachiv.com website and the Nebachiv mobile app.
Product — digital educational content: courses, learning materials, video lessons and interactive collections accessed through your account.
2. Subject
We grant you personal access to the paid Product through your account on the Platform.
Access to one-time purchases is granted for the lifetime of the Platform.
Access is personal and may not be shared or transferred.
3. Payment and access
Prices are listed at nebachiv.com/en/pricing.
Payment is made by bank card, Apple Pay or Google Pay via a payment acquirer.
We do not store or have access to your full card details — they are processed by the payment provider.
Access unlocks automatically in your account after the payment is confirmed.
4. Refunds
Refund terms and procedure are described in the Refund Policy (nebachiv.com/en/legal/refunds), which is an integral part of these terms.
5. Educational nature of content (important)
Nebachiv is an educational platform. The content is analysis and personal experience, not professional advice.
- The Platform does not replace motorcycle school training or official licensing.
- Consuming the content does not guarantee road safety and does not eliminate the risk of accidents.
- You are solely responsible for your actions on the road and must always follow traffic rules.
- Third-party videos are used solely for educational analysis.
6. Limitation of liability
The Provider’s aggregate liability is limited to the amount you actually paid for the relevant Product.
We are not liable for indirect damages or for the consequences of your decisions and actions based on the Platform content.
7. Age requirement
The Platform is intended for persons aged 16 and older.
8. Intellectual property
All original Platform content is protected by copyright. Copying, distributing, publishing or sharing access to paid materials is prohibited.
9. Changes to terms
We may change these terms with at least 30 days’ notice for material changes, via email or the Platform. Changes do not worsen the terms of already purchased Products.
10. Governing law and contacts
These terms are governed by the law of Ukraine.
